Flat roof Workmanship Warranty 2020

This is a workmanship warranty provided by BRAX Roofing, to you, the original purchaser (“Owner”). Please consult your third-party product and/or manufacturer warranties for further coverage.

Limited Workmanship Warranty

BRAX Roofing will perform all work in a professional manner using high-quality materials and supplies, and in conformance with applicable building code standards. BRAX Roofing warrants to the Owner that the installation work performed by BRAX Roofing will be free of defects due to workmanship for the specified warranty period in the chart below, subject to the other terms and conditions contained in this warranty and original contract.

How to Obtain Warranty Service: To submit a claim, a copy of this warranty and a copy of the Owner’s sales contract must be submitted in writing by registered mail to BRAX Roofing (also referred to as “we” or “us”) with a brief explanation of the claim. Claims must be submitted to us promptly after discovery of the claimed defect and within the applicable warranty period. Within a reasonable period after having received the Owner’s claim, we will schedule an appointment to inspect the premises and the warranty claim. If after inspection, we determine that a valid claim exists, we will repair, re-install, replace, or refund the purchase price of the failing service, at our option. If we decide to replace any or all product(s), and if such product(s), as originally installed, is no longer available, we shall have the right to substitute product(s) designated by us to be of equal quality. Replacement of a product or component does not renew the warranty period. If, at BRAX Roofing’s option, a purchase price refund is conveyed to the Owner, then this warranty is terminated, and the repair, replacement, or removal of the product shall become the sole responsibility of the Owner. This warranty is not valid unless and until the Owner has made full payment under the original sales contract and all addenda thereto. Non-warranty calls for repair or adjustment or calls under a third-party product and/or manufacturer warranty (i.e., claims not related to this workmanship warranty) may result in a service charge.

What Is Not Covered: BRAX Roofing grants this warranty to the Owner only and only materials purchased from and installed by us are covered by this warranty. This warranty assumes normal and reasonable use of products or components. This warranty does not cover any other damage or material failure including, but not limited to, damage caused by occurrences beyond the control of BRAX Roofing, such as acts of God, settlement of the building, failure of the structure (including foundations and walls), use of incompatible accessories, removal, repair, or re-installation of any products or components by other than BRAX Roofing, normal corrosive effects of salt air and chemical pollutants, intentional acts, unreasonable use or failure to provide reasonable maintenance as and when necessary, or damages due to or arising from the identification, detection, abatement, encapsulation or removal of mold, asbestos, lead-based products, or other hazardous substances inside or outside of the structure being improved. Installation, removal, repair, adjustment, tampering, or re-installation of any products or components by other than BRAX Roofing voids this warranty, and BRAX Roofing expressly disclaims any liability for any costs, defects, or damages with respect to such actions.

Transfer of This Warranty: Subject to the other terms and conditions contained in this warranty, this warranty is transferable one time. To transfer this warranty, the Owner must request an inspection and re-certification of the products installed by BRAX Roofing, and upon inspection and re-certification to the satisfaction of BRAX Roofing, or BRAX Roofing’s waiver of the inspection and re-certification, this warranty shall transfer to the subsequent homeowner. All terms of this warranty shall apply to the subsequent homeowner. No further transfers of this warranty are permitted.

Remedies and Rights: This warranty is the only expressed warranty provided by BRAX Roofing. No employee, representative, agent, or any other person, has authority to assume or incur on behalf of BRAX Roofing any obligation, liability, or responsibility in place of or in addition to this warranty. BRAX Roofing HEREBY EXCLUDES AND DISCLAIMS ANY AND ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BY WAY OF ILLUSTRATION AND NOT LIMITATION, WARRANTIES OF FITNESS FOR PARTICULAR PURPOSE, HABITABILITY, AND MERCHANTABILITY. THE LIMITED WARRANTIES CONTAINED HEREIN SHALL BE IN LIEU OF ANY OTHER WARRANTY, WHETHER EXPRESSED OR IMPLIED. BRAX Roofing’s liability to the Owner under this warranty is limited to the amounts received by BRAX Roofing for services rendered under the sales contract with the Owner. In no event shall BRAX Roofing be obligated or liable for incidental, special, indirect, or consequential damages of any kind for the breach of any express or implied warranty.
